NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

IMPORTANT: These are the Official Rules of the Broadway Dream Vacation Sweepstakes (the "Sweepstakes"). By submitting an entry and participating in the Sweepstakes, you agree to be bound by these Official Rules, and represent that you satisfy all of the eligibility requirements below.

1. ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASING A PRODUCT OR SERVICE WILL NOT INCREASE YOUR CHANCES OF WINNING. Open to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age on the date of entry into this sweepstakes (the “Entrant”). Employees, officers and directors of Broadway Records (the “Sponsor”), and parent and affiliated companies, agents, franchisees, licensees, successors and assigns, distributors, vendors, advertising, marketing and promotions agencies, prize providers (as set forth in Section 5 below) and suppliers and any other individual or company involved in the development or execution of this Sweepstakes, as well as their immediate family members (spouses, siblings, children and parents, regardless of where they live, or whether related by blood or law) or members of the same households (whether related by blood, law or not) of such employee, officer or director are not eligible to participate in this Sweepstakes or be awarded a Prize (as defined below). All federal, state and local laws, rules and regulations of the United States apply. This Sweepstakes is void where ever prohibited by law. In order to enter the Sweepstakes or receive the prize, entrants must fully comply with the Official Rules, including all of the Terms and Conditions of the Sweepstakes. The decisions of the Sponsor shall be binding and final in all respects relating to the Sweepstakes. If grand prize winner chooses to bring a child as their guest, said winner understands that each prize provider may have their own rules about age limitations, and children under the age of four (4) are not permitted in theaters. Winners must have a valid photo ID that matches the name used to enter in order to pick up their tickets. 

Only one entry per person. 

Entrants must comply with the Terms and Conditions of the sweepstakes, including applicable exclusions and limitations. Entrants are not permitted to share the same email address or use more than one account per social media platform. In the event of a dispute over the identity of an entrant, the entrant will be deemed to be the authorized account holder of the email address identified at enrollment into the Sweepstakes, which authorized account holder must also be the subscriber of the applicable Facebook, Twitter or other social sharing account used by the entrant. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider, or other organization (e.g., business, educational institute, social sharing site) that is responsible for assigning email addresses for the domain associated with the applicable email address.

2. SWEEPSTAKES SUBMISSION PERIOD: Broadway Dream Vacation Sweepstakes (the “Sweepstakes”) begins at 10:00 a.m. Eastern Standard Time ("EST") on October XX, 2020 and ends 6:00 p.m. EST on September 1, 2021 (the "Sweepstakes Period").

3. METHOD OF ENTRY: Access the Sweepstakes’ official entry page during the Sweepstakes Period at www.BroadwayRecords.com/sweepstakes. You may enter your Entrant Information (as defined below) and answer the survey questions at such website location (“Entry Site”). When prompted at the Entry Site, acknowledge you have read and agree to the Official Rules and provide the information requested on the official entry page in its entirety including your first name, last name, email address, gender, age, and location (city/town, state, country) (the “Entrant Information”). After you acknowledge the Official Rules and enter the Entrant Information, answer all questions included on the form. You must complete the entire official entry page in order to be eligible to win. Entries submitted or completed by anyone other than the Entrant are void. No mechanical reproductions or automated entries will be accepted. The Sponsor will not verify receipt of your entry into the Sweepstakes. All entries submitted become the sole property of Sponsor and will not be returned.

4. WINNING/ODDS: The odds of winning depend upon the number of qualified entries received by Sponsor during the Sweepstakes Period. On or about September 1, 2021, a random drawing will be conducted by Sponsor from amongst all eligible entries received during the Sweepstakes Period to choose one (1) Grand prize winner (the “Grand Prize Winner”) and XX first place winners (the ‘First Place Winners)

Approximate Retail Value of Grand Prize is $4350.00. Approximate Retail Value of First Prize is $50 each. Winners will not receive difference between approximate and any actual retail value. NO PRIZE SUBSTITUTION WHATSOEVER BY WINNER. Sponsor reserves the right to substitute any portion of any Prize with a prize of equal or greater value. There is no monetary value associated with the prize. No substitutions or cash redemption of a prize is permitted and prizes are not transferable. The value of a Prizes are taxable in the United States as ordinary income to the Winner who will be solely responsible for the payment of all taxes levied, including, but not limited to federal, state and local income and/or gift taxes. All unspecified costs and expenses associated with the acceptance or use of the Grand Prize (including but not limited to travel to and from the airport or to and from any performance, attraction, retail store, etc)) are the sole responsibility of the Winner. Unclaimed prizes will not be awarded. Sweepstakes availability and the number of prizes may vary and are subject to change without notice. Sweepstakes may be revoked or modified at any time without notice. The seat locations of tickets may be anywhere in the theater (including orchestra, mezzanine, balcony or boxes of the theater), may not be handicapped accessible and may have a partial, restricted and/or obstructed view of the stage. Additionally, seats may not be located next to each other. Seats cannot be transferred to other performances. Blackout dates may apply for all prizes. Attractions and restaurants requiring reservations are subject to reservation process and availability. Winner is responsible for booking their own attractions and restaurant reservation, using reservation methods provided by the sponsor or prize provider. Additional restrictions may apply.

6. WINNER SELECTION/NOTIFICATION: The Winner will be notified by email on or about September 1, 2021 before 6:00 PM EST (“Notification”). Winner must respond by telephone or email to the Notification within 3 business days after Notification is placed or sent (Sponsor will retain time stamp of telephone and email transmissions), indicating that the Winner is eligible and intends to accept and use the Prize. If the Winner does not respond in accordance with these Official Rules, or if he/she is otherwise ineligible as determined by the Sponsor in its sole discretion, an alternate Winner may be selected from among the remaining eligible entries received during the Sweepstakes Period, and he/she will be notified as outlined above. Winner will be required to complete and return the Required Documents (as defined below) and to fulfill all other conditions and requirements listed herein. POTENTIAL PRIZE WINNER(S) ARE SUBJECT TO VERIFICATION BY SPONSOR WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROGRAM.

7. PRIZE CLAIMS: Except where prohibited by law, Winner must submit proof of identity and execute and return to Sponsor an affidavit of eligibility/liability/publicity release in a form to be furnished by Sponsor (the “Release”), and a copy of his/her governmental issued identification with photograph (e.g. a valid driver’s license or passport) (collectively, the “Required Documents”). Winner must deliver the Required Documents to Sponsor via facsimile or email (a facsimile number or email address will be provided by Sponsor). The Required Documents are to be time stamped, in the case of email or facsimile no later than three (3) business days after Sponsor’s email transmittal of the required blank Release. In Sponsor’s sole discretion, a Winner will be disqualified and will forfeit the right to claim a Prize (and an alternate Winner may be selected in accordance with these Official Rules from among the remaining eligible entries for the Prize) if the selected Winner (i) fails to verify eligibility for the Prize in the time required by these rules, (ii) fails to return all Required Documents within three (3) business days after Sponsor sends the blank Release to the Selected Winner, (iii) either fails to accept the Prize or declines the Prize (or advises that he/she cannot accept, receive or use a Prize), or (iv) otherwise fails to comply with the Official Rules. By entering this Sweepstakes, Winner consents to the use of his/her name, image, likeness, biographical information (including city and state of address), voice and/or any statements made by such Winner regarding the Sweepstakes or Sponsor (regardless of method of production) for advertising or promotional purposes, worldwide and in perpetuity, in any and all forms of media now known or hereafter developed, without notice or additional compensation (except where prohibited by law). No more than the number of prizes set forth in these Official Rules will be awarded. Internet entry must be made by the entrant, only at the Website. Entries made by any other individual or any entity, and/or originating at any other web site or email address, including but not limited to commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified for this Sweepstakes. The use of any device to automate the entry process is prohibited and will result in disqualification. Duplicated entries will be disqualified. Entries are void if unreadable, inaccurate, incomplete, forged, mechanically reproduced, irregular in any way, or otherwise not in compliance with the Official Rules. If an entrant or Winner is found in violation of the Official Rules their submission may be disqualified and/or prize revoked.

8. ENTRY CONDITIONS AND RELEASE

By entering, each participant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor, NYC & Company, promotional partners, prize suppliers, and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents, successors, assigns, and representatives (collectively, the "Released Parties") from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant's entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (c) indemnify, defend and hold harmless the Sponsor, NYC & Company, each of their affiliate entities, promotional partners, prize sponsors and all of their respective officers, directors, employees, agents, successors and assigns from and against any and all claims, expenses, and liabilities (including reasonable attorney's fees) arising out of or relating to an entrant's participation in the Sweepstakes and/or entrant's acceptance, use or misuse of any prize. All federal, state, and local taxes levied on account of a Prize Winner are the sole responsibility of such Winner.

9. PUBLICITY

Except where prohibited, participation in the Sweepstakes constitutes winner's consent to Sponsor's and its agents' use of winner's name, likeness, photograph, voice, opinions, biographical information, statements and address (city and state) for advertising and/or publicity purposes worldwide and in all forms of media now known or hereafter developed, in perpetuity, without payment or consideration.

10 GENERAL CONDITIONS

Sponsor reserves the right to modify, extend, suspend or terminate the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor assumes no responsibility for any damage to an entrant's or any other person's computer system or wireless phone which is occasioned by accessing the Website or otherwise participating in the Sweepstakes, or for any computer system, phone line, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, difficulties or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. In the event Sponsor is prevented from awarding prizes or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date/time, Sponsor will (if possible) select winner(s) in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such drawing shall be each entrant's sole and exclusive remedy under such circumstances. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

11. RELEASE AND LIMITATIONS OF LIABILITY

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes or receipt or use or misuse of any prize. In event that production, technical, seeding, programming or any other reasons cause more than stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by selecting the winners from among all legitimate, unawarded, eligible prize claims. If, for any reason, the Sweepstakes is not capable of running as planned for any reason or any cause which, in the sole opinion of the Sponsor, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the Sweepstakes, the Sponsor reserves the right, in its sole and absolute discretion, to modify these Official Rules and/or to cancel, terminate, modify, or suspend all or any part of the Sweepstakes, and in its sole discretion to select any one or more new potential winners from among all eligible entries received up to the time of such cancellation, termination, modification, or suspension, as applicable. Notwithstanding anything to the contrary in these Official Rules, Sponsor reserves the right to discontinue or suspend the Sweepstakes at any time for any reason or no reason.

12. DISPUTES

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate New York State Court located in New York County, New York; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, , but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

14. SWEEPSTAKES RESULTS

For Sweepstakes results, send a written request to Broadway Dream Vacation Sweepstakes - Winners List c/o Broadway Records, PO Box 1505, New York, NY 10101. Requests for the Winner's List must be received within 60 days after the end of the Sweepstakes Submission Period.
